Liability for Inadequate Truck Maintenance
In many cases, accidents involving large, commercial vehicles are caused by drivers’ negligent behavior on the road. However, drivers are not always at fault, and some accidents occur as a direct result of malfunctioning parts and insufficient maintenance.
Trucking companies, drivers, and maintenance workers are all required to abide by the standards set forth by the Federal Motor Carrier Safety Administration (FMCSA), including those that pertain to truck maintenance. Truck drivers are required to personally conduct an inspection of their own vehicle before driving, and they are required by law to report any issues and perform all necessary repairs before hitting the road again. In some cases, maintenance is also conducted by a third party or other trucking company employee.
